Terms of Service

These Terms of Service ("Terms") govern your access to and use of ContinuityBot, a conversational AI platform provided by Foxburg Creative Agency(GST No.: 32AAIFF3153B1Z2) ("Company," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using ContinuityBot, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Description of Services

ContinuityBot provides AI-powered conversational tools that help businesses manage customer interactions across WhatsApp, Instagram, Facebook Messenger, and web chat. Features include automated replies, lead capture, enquiry management, product inventory search, FAQ matching, document search, and pipeline-based conversational workflows.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to use ContinuityBot to:

• Violate any applicable law or regulation.
• Send spam, unsolicited messages, or harassing content.
• Impersonate any person or entity.
• Interfere with or disrupt the integrity or performance of our services.
• Attempt to gain unauthorized access to any part of the service or related systems.
• Use automated means (bots, scrapers, etc.) to access the service outside of its intended functionality.
• Reverse-engineer, decompile, or disassemble any part of the service.

5. Subscription and Billing

• Certain features require a paid subscription. Plan details and pricing are available on our dashboard.
• Subscription fees are billed in advance on a monthly or annual basis, as selected.
• All fees are inclusive of applicable taxes as per Indian GST regulations.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to modify pricing with 30 days' advance notice.

6. Intellectual Property

All content, software, and intellectual property associated with ContinuityBot are owned by Foxburg Creative Agency. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms. You retain ownership of content you upload (such as product data, FAQs, and documents), and grant us a limited license to process and store such content solely to provide the service.

7. Data Processing and Privacy

Your use of ContinuityBot is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and the information of your customers.

8. Third-Party Integrations

ContinuityBot integrates with third-party services including WhatsApp (Meta), Instagram (Meta), Facebook Messenger (Meta), and others. Your use of these integrations is subject to the respective third-party terms of service. Foxburg Creative Agency is not responsible for the availability, accuracy, or policies of third-party services.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may experience downtime for maintenance, updates, or factors beyond our control. We will make reasonable efforts to provide advance notice of scheduled maintenance.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Foxburg Creative Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the service. Our total cumulative liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Foxburg Creative Agency, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to ContinuityBot at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. You may terminate your account at any time by contacting us or through your account settings.

13. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the service at least 30 days before they take effect. Continued use of the service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India. You and Foxburg Creative Agency agree to attempt to resolve any dispute informally for at least 30 days before initiating legal proceedings.
